However, implicitly the right to privacy is contained in Article 28G paragraph (1) of the 1945 Constitution of the Republic of Indonesia as follows:\n\n&#8220;Every person has the right to protect themselves, family, honor, dignity and property under his authority, and is entitled to a sense of security and protection from the threat of fear to do or not do something that is a human right&#8221;.\n\nIn the Constitutional Court Decision Number 50 \/ PUU-VI \/ 2008 concerning Case Testing of Law Number 11 Year 2008 concerning Information and Electronic Transactions, the Constitutional Court provided translation of Article 12 of the UDHR and Article 17 of the ICCPR. In the translation, the word &#8220;privacy&#8221; is translated as &#8220;personal matters \/ personal matters&#8221; as stated in Article 28G of the 1945 Constitution of the Republic of Indonesia as follows: Article 12 UDHR:\n\n&#8220;No one shall be subjected to arbitrary interference with his privacy, family, home or correspondence, nor to attacks upon his honor and reputation. Every person has the right to get legal protection against such disturbances or violations. &#8221;\n\nThe conditions read as follows:\n\n&#8220;Basically, information owned by a person is a personal right that must be protected so that wiretapping must be prohibited&#8221; Article 40 of Law Number 36 Year 1999 concerning Telecommunications\n\nIn general, the concept of protecting personal data is considered as part of the protection of privacy, which is a specific concept of privacy itself, where privacy is a fundamental human right, and data protection is one way to protect privacy itself.\n\nHowever, in some circumstances, these provisions can be distorted so that wiretapping actions are allowed as regulated in Article 42 paragraph (2) letter b of Law Number 36 Year 1999 concerning Telecommunications which states, &#8220;for the purposes of criminal justice processes, telecommunications service providers can record information sent and \/ or received by telecommunications service providers and can provide information needed at the request of investigators for certain criminal acts in accordance with applicable Laws. &#8221;\n<h2>Protection of Privacy and Personal Data of the Indonesian Community<\/h2>\nConstitutionally, the State protects the privacy and data of the population. Article 28G paragraph (1) of the 1945 Constitution of the Republic of Indonesia (&#8220;1945 Constitution&#8221;) reads:\n\n&#8220;Everyone has the right to protect themselves, family, honor, dignity, and property under his authority, and is entitled to a sense of security and protection from the threat of fear to do or not do something that is a human right.&#8221;\n\nIn line with Article 28G paragraph (1) of the 1945 Constitution, Article 2 of the Adminduk Law stipulates that:\n\nEvery resident has the right to obtain:\n\nPopulation Documents;\n\nthe same service in Population Registration and Civil Registration;\n<ul>\n \t<li>protection of Personal Data;<\/li>\n \t<li>legal certainty over document ownership;<\/li>\n \t<li>information regarding data on the results of Population Registration and Civil Registration of himself and \/ or his family; and<\/li>\n \t<li>compensation and restoration of good name as a result of errors in Population Registration and Civil Registration as well as misuse of Personal Data by Implementing Agencies.<\/li>\n<\/ul>\nGovernment Regulation Number 40 Year 2019 concerning Implementation of Law Number 23 Year 2006 concerning Population Administration As Amended by Law Number 24 Year 2013 concerning Amendment to Law Number 23 Year 2006 concerning Population Administration (&#8220;PP 40\/2019&#8221;) is the implementing regulation of the Adminduk Law and its amendments.
